• Informed consent requirements;
• Monitoring and follow-up care; and
• Compliance with all applicable legal and professional obligations.

Users are solely responsible for ensuring compliance with all applicable federal, state, and local laws, including but not limited to laws governing:

• Telehealth;
• Medical practice;
• Pharmacy practice;
• Patient privacy and data security;
• HIPAA compliance;
• Informed consent;
• Recordkeeping;
• Adverse event reporting;
• Controlled substances;
• Medical advertising and promotion; and
• Any other applicable healthcare regulatory requirements.

Healthcare providers acknowledge and agree that they assume all risks associated with the prescribing, dispensing, administration, storage, handling, and use of any product obtained through this Platform.

Providers further acknowledge that individual patient outcomes may vary and that no guarantees regarding safety, efficacy, suitability, effectiveness, or treatment outcomes are made by Onboard Health LLC.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM, PRODUCTS, SERVICES, CONTENT, INFORMATION, AND MATERIALS ARE PROVIDED "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

ONBOARD HEALTH LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, QUALITY, SAFETY, EFFICACY, OR UNINTERRUPTED AVAILABILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, ONBOARD HEALTH LLC, ITS AFFILIATES, OWNERS, MEMBERS, MANAGERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, PARTNERS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

• The purchase, prescribing, dispensing, administration, storage, handling, or use of any product;
• Clinical decisions made by healthcare providers;
• Patient outcomes or adverse events;
• Regulatory compliance obligations;
• Reliance upon information provided through the Platform; or
• Any alleged injury, loss, claim, demand, or cause of action arising from use of the Platform or products offered through the Platform.

Users agree to defend, indemnify, and hold harmless Onboard Health LLC and its affiliates, owners, members, managers, officers, directors, employees, agents, contractors, licensors, suppliers, and successors from and against any and all claims, demands, actions, investigations, liabilities, damages, losses, judgments, settlements, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Violation of any law or regulation;
• Professional negligence or malpractice;
• Clinical decisions or treatment recommendations;
• Improper prescribing, dispensing, administration, storage, or use of products;
• Patient injury, adverse events, or treatment outcomes;
• Breach of these terms; or
• Misuse of the Platform or any products obtained through the Platform.
